What is the Constitutional Law?

What is the constitutional law? This is quite a broad and complex question, but essentially constitutional law is the study, practice, interpretation, and administration of the nation's foundational laws. These rudimentary laws are based on the U.S. Constitution and deal with issues such as the rights of individual U.S. citizens and the relationship between the states and federal government. Constitutional law regulates the scope of power available to the U.S. government. This area of law regulates the creation and execution of law by the U.S. government as well. Constitutional law guides the implementation and interpretation of the nation's constitution.

Even with this description, questions probably still remain about what is the constitutional law. A further explanation of this area of law may provide additional insight. Constitutional law helps judges, lawmakers, and others determine whether the words contained in the constitution should be taken literally or if there is room for interpretation. Many remain divided on this issue as some say the terms and words used in the constitution are either archaic or vague leaving room for individual interpretation. Because individuals can interpret the constitution differently, constitutional law helps to provide a basis through which to interpret this document. All forms of law fall under the umbrella of constitutional law, and this important area of law overrides all others.

One important thing to keep in mind when researching what is the constitutional law is whether or not the subject involves state law or federal law. Constitutional law established by the U.S. Constitution supersedes all state laws, but every state has a constitution as well. Therefore, there are really two types of constitutional law in the U.S.: state and federal. Because both state and federal constitutions can be amended, the laws are not always static. Constitutional law is a complicated subject with what may seem many peculiarities at times, but it is the basis of all the laws established in the U.S.
