DUI Arrest Records

When an individual is arrested for driving under the influence (DUI), their arrest record becomes a matter of public record. Public records are those legal records that can be viewed by anyone in the general public. Current or potential employers can have access to an individual's public arrest records as well as their family, friends, relatives, and complete strangers. DUI arrest records can be harmful to an individual's reputation and career. Individuals with these types of records may be seen as irresponsible, a menace to society, and lacking dependability and trustworthiness. It is important the individuals charged with a DUI, whether yesterday or 20 years ago, take steps to clear their arrest record.

Some states allow an individual's DUI arrest records to be expunged (cleared) while others offer alternatives designed to minimize the damaging ramifications of a DUI arrest. However, the circumstances surrounding the DUI can vary; therefore, some DUI offenses are not eligible for expungement. DUI offenses that are not eligible for expungement include: vehicular homicide related to DUI charges, DUI charges accompanied by felony drug charges, and DUI offenses involving significant property damage or serious injury. DUI arrests that do not fall into these categories may be eligible for expungement.

While individuals can undertake the task of clearing their arrest records on their own, they may be able to do so more effectively and expediently with the assistance of an experienced and skilled criminal defense attorney. An attorney can review the DUI arrest case to determine if the record is eligible to be cleared. If the record can be cleared, an attorney will have a complete and thorough understanding of the expungement process and can provide expert guidance throughout the process. Because a DUI arrest on an individual's record can negatively impact the reputation of the individual, the cost and time associated with endeavoring to clear a DUI arrest from public record may be well worth the effort.
